Chase Online not honoring promotional offer

I just sent this letter to “The Office of the President” at JP Morgan Chase Bank in Delaware:

On 3/31/04 I took advantage of a 0% balance transfer offer on the Chase OnLine Web Page for transfers over $10,000. My problem is that I have been charged the full finance charge each month since the balance transfers took place.

The offer expired on 9/15/04. I called to complain shortly after this date and was assured that my account would be corrected.

I called again on 10/22/04 and spoke to a supervisor named “Tom”. He reviewed the account and determined that I should be credited $866.60. This amount did not seem correct to me due to compounded finance charges. Tom advised me to send a letter to Chase.

I sent the letter on 2/3/05 and just received a response back that said “Our records indicate the balance transfers processed on April 6, 2004 were posted at the purchase rate due to no balance offer available.” (Now you’re calling me a liar!)

I called Chase today and spoke to “Linda”. She said that because I notified Chase after the offer expired (on 9/15/04) that I wasn’t entitled to the 0% balance transfer.

The offer was in place on 3/31/04 when I initiated the balance transfers on your webpage. It doesn’t matter when I called to complain.

The adjustment should have been automatically applied to my account during/after the Chase Online Webpage balance transfer processing. This is Chase’s mistake, not mine.

I would like my account reviewed and adjusted accordingly (month by month) from 3/31/04 forward. So far, I’ve lost over $1000 due to Chase’s negligence.

My question: If they again refuse to resolve this issue, what recourse do I have?

I’ve lost over $1200 so far in interest charges. I just paid off all but the last $1500 incase I need to use this amount for bargaining power (held in dispute). I’m afraid to just say that I’m not paying the final amount until the matter is resolved for fear of having it affect my credit report (which is flawless).

What’s my next step & where do I go for help?

Received a reply today - same as last time. They deny that a promotional offer was in place at the time for the balance transfers.

They will admit that the offer was in place when I made the transfers on the phone (on 4 different phone calls since September 2004), but not in their letter responses.

I paid off the account and it now has a zero balance.

I need to take them to court now. I guess that the first thing I need is proof from them that the offer was in place. Can I file something (discovery) to make them furnish the proof or does it need to come from an attorney or the court?

You can ask for discovery after your lawsuit is filed, yes - if you're ready to take this on pro se (no lawyer). Do you have any proof of what you claim was on their website ?? Did you print out anything from the site that backs up your claim that there WAS a promotional offer ??

The biggest problem that *I* see is that you waited far too long to dispute this and then you disputed only by phone. Your dispute should have been done MUCH earlier and it SHOULD have been IN WRITING. These banks don't give a rats patoot and conveniently 'forget' and phone conversations even if they SAY they're making notes in the computer while you're talking to them - who knows what kind of drivel they're inputting. They're minimum wage phone drones, they don't care !

According to the back of my credit card statement for Chase (was BankOne), you have to WRITE to Cardmember Services (at address indicated) as soon as possible if you notice an error. "We must hear from you no later than 60 days after we sent you the first bill on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights." It goes on to say what info you should include in the LETTER.

So it looks like you missed the time frame to do anything about it, unless it was worded differently at that time.
