What is the name of your state? Florida

I have been married to a Brazilian who is currently awaiting her Permanent Residency Status. We have been waiting for the interview process that should be coming up shortly. I recently caught her cheating on me with a coworker at her job. I also found out going through her records that she had an abortion without my knowledge during the time we were together. Needless to say... it's OVER. I want a divorce as soon as possible.
My main question is if I divorce her, will she be sent back to her country? The marriage seems to have been a sham all along, so I wouldn't be hurt too badly if she was deported. What is the process for something like this?
We also recently purchased a house together and both of our names are on the mortgage. I assume she still will have legal rights to the house unless she "agrees" to have her name taken off the mortgage. A quit deed will work if she signs it but it may cause the mortgage comapny to demand payment in full of the balance if I'm not mistaken. Refinancing could be difficult due to current financial hardships. Do I have any other options? We did sign a pre-nuptial but it only included assets acquired before the marriage and not purchased jointly.
I'm really hurting here so any advice is greatly appreciated.

My response:

We don't do "plans of attack" on these forums. That's for you and your lawyer.

But, I'll bet you dollars to donuts that no one could have told you to "stop" before you were married, and that you were warned about how foreigners just want you because of the potential to get a Green Card, and then, perhaps, Citizenship. Yeah, you were warned - - and it's all come true, but you wouldn't listen. We see this happening all the time.

You're on your own, kiddo. See a local Family Law attorney.

To Liable

Hey guy... thanks for the sympathy. Why bother responding!? I'm looking for some needed advice, not a lecture from someone like you. If you can't be helpful... keep your opinion(s) to yourself.

My response:

We're not here to give you "sympathy", either. No pillows and no soft, warm blankets. You don't want a lecture? Tough! It's about time you listened, right? Everyone was telling you before, but you wouldn't listen then!

So, I'll respond any damn time I please, and I'll respond with whatever information I deem appropriate. Okay with you?

Liability

Sorry man... I didn't know you weren't dealing with a full rack. You are "liable" to get a life though, so why don't you wipe those donut crumbs off your fat cheeks and get out of the house for some exercise. I've noticed you slamming others on these forums too so I can only imagine you have quite an inferiority complex. I'm done with you... your remarks will put you in your place just fine. Good luck... hope the Prozak works.

To other readers: Sorry about my getting off track here but I had to say something to this idiot. (smile)

My response:

Oh, I love it!

Look who's calling who an "idiot"! Wow, you sure know how to identify an "idiot", don't you!

Is there a mirror near you?

" . . . your remarks will put you in your place just fine." And your foreign wife will kick you out of "your place just fine". Ha, ha, ha, what a dope!

Quick thought, doesn't she need a sponsor to receive her "Permanent Residency Status"? They're right, you should check with immigration, go to them and find out what would stop her from getting her "Permanent Residency Card". That would be the place I would start. If she doesn't get that then, she may be on her way back to where ever it is she came from. You also may want to move this to "Immigration", because that's where it's headed.

Good Luck
Dennis
