When trying to determine child abandonment in Tennessee, will the courts consider supervised visits as token visitation when the biological parent shows up for about half of them and shows no desire for anything more. The court (not her) has set up 3 different 6 month reviews in the past 2 years to evaluate visitations and the court has refused to order any more visitation due to her failure to follow court orders and her continuous drug use and refusal of court ordered counseling. They have discontinued the evaluations and we have not been back for a review in 10 months.
She has also failed to pay child support for 2 years, the child was removed from her home because of neglect, and she was also incarcerated for violation of probation during the time in which the petition for adoption/terminating parental rights was filed. She was convicted of child neglect being the reason she is on probation and the reason my husband has exclusive custody.
She has refused to sign over her parental rights willingly, but still shows no desire to take on the parental obligations. We pray daily that the courts will see that she has no desire to change and terminate her parental rights so that I may adopt him.
Any advice would be appreciated.
