child abuse being passified.what can i do?

What is the name of your state? california
I am primary care giver for my daughter. My oldest (8yrs)daughter is being bitten on by her mother. It has been confirmed that her mother is biting her based on testimony from my daughter and her mother. The bruises on my daughter have lasted for periods lasting more than 32 days and cause her enough pain to make a report to her teacher. DCS has been involved and has defined the actions taken by mother as abuse. Pictures, doctor reports, teachers written testimony have all been provided to the court and yet no provisions have been put in place to provide protection or a safe environment for my daughter because no one knows what to make of the a case of biting. This is abuse that is being passified.
what can i do to protect my child?
can i sue the state for allowing this abuse to continue?
SOMEONE PLEASE HELP!!!!!!!
i have a lawyer but i get 0% help from him but he's great at taking my payments.

Biting, unfortunately, is not an unheard of type of abuse. I cannot imagine what the hold up is re; this case.

Contact the Office of the Ombudsmen (they oversee CPS) Get an advocate to look into the case, and contact the case worker and give them a shove.

Have you filed for Emergency Temporary Restraining Order? Do that immediately. Provide teacher's statement, Dr. records, CPS contact information. This will get the ball rolling re; stopping visitation. Then there will be an assigned date for a hearing. They may supervise her visits, stop her visits, order anger management &/or parenting classes.

WHY is your attorney NOT acting on this? Have you left anything out? :confused:

DO NOT send the child back to Mom's...especially since the abuse has been discovered/proven. The child is at great psychological risk with the Mother right now.

Get on your attorneys butt!

thanks for your advice but everything you stated has been done. doctors notes, teacher statement, photos and i have several recordings of mom telling me she didnt do it and my daughter fell and hurt herself. we have been to cps and parenting classes have been ordered for mother and she will not do it. the court dismisseed a emergency order (but i saw many woman get it for lesser reasons that same day).
moms excuse is that she was just playing but then it happen again only 1 week before we went back to court.
the court wouldnt even take the time to stop visitation to find out what was going on. in fact if she wants more time she'll likely get it.

the problem that i keep hearing is that my daughter wont say that she is scared of her mom. the way i see it, it doesnt matter if she is scared or not. mom should not be allowed to abuse my daughter! the proof is in the courts face in fact when the last bite happen the judge said "well what do you want me to do".

my lawyer wants to go to trail but i think thats just spending good money after bad. itll still be the same judge and i dont know what other facts or proof can be added.

what id like to do is sue the state. the proof of abuse was there and notthing was done. abuse happen again and notthing has been done :mad:

Get the child in therapy!!! If you cant afford it, look for one that works on a sliding scale. A theripist testamony will go a long way in court

You've done most of the work, I agree...however you missed the most important information: Contact the Office of the Ombudsmen. They are not the same as CPS~ and in fact oversee CPS and look into CPS cases when necessary. If anyone can 'spur' CPS to further action, it is the Office of the Ombudsmen.

And again, therapy. Therapy doesn't require child stating she is afraid of mother- that will come out during therapy sessions...and THEN you will have a professional opinion as to the effect upon the child...and further basis to pursue custody action.
