my son is currently in the dhs custody of oklahoma for allegedy deprived custody. My new husband and I went to court in August 2000, we are currenty taking care of my son but my son is techincally still in custody of oklahoma. In Feburary we go to court and they will recommend a 6 month probation period. My husband wants to adopt my son. We decided it would be better off not to until dhs was no longer involved. I was just wondering is it possible for my husband to go ahead and file for the adoption even though my son is still in Dhs cutody. My husband and I live in the state of Texas now.
