Child Suport Enforcement Against Military Personnel

What is the name of your state? GEORGIA.

My child's father recently (a week ago) joined the United States Army. I have not received support in at least 6 months. In January of 2005, I obtained a judgement against him in court for willful contempt, and he served a few days in jail and was released. Since then, his child support payments have been inconsistent and he is now in arrears for roughly $4,600.00. Does anyone have advice for enforcing a child support order against someone who is in the military? Is it possible to just get a warrant for his arrest at this point? Please help.

Depending on what branch of service, there is one specific payroll department at one specific location.

You need to google them, and phone them. You will need a *Order to with hold pay* from the court, and send it to them. His pay will then be garnished.

If he's in jail, he can't pay you can he?

Follow Shay's advice.

I will add however that the military is really good about making sure that its personel support their kids.

You know, the horrible thing is that if someone wants to make trouble--all they have to do is call the comanding officer. I have a friend in the marines and his kid's mom called his CO lying about not receiving her CS. He almost got demoted. It turned into a huge fiasco and apparently Mom knew this. The military takes these things very seriously. Luckily my friend had all his documentation in order to prove he had paid but he was quite scared for a bit.

Was a garnishment order even issued to begin with? If not, then there's the problem right there.

Is it possible to just get a warrant for his arrest at this point?
No. As someone questioned, if he goes to jail, where do you tihnk the money would come from?

And I certainly hope he's considering filing a civil suit against her for this crap.

Apparently she has done it a few times since--if the CS does not arrive in her bank account on the 1st of the month etc. But the CO now understands that she is looney and trying to cause issues. According to my friend though, every time she calls, there is an investigation. He has to provide his proof of payments made. I think now it is just a formality as the CO knows her history but they still must do it. The military does not play around. or at least the Marines dont.

Being in the USAF, I would recommend calling his equivelent(sp?) to his First Seargent. The First Shirt as we call him handles all things related to personel. If you call his CO the CO just passes it to the Shirt anyways. My email addy is ultranub47@gmail.com. penguin...Don't take it personally...But no one here knows who you are and if you are even IN the military...For all we know you could be a crazy guy ....or girl....!:eek: ;)

no offense taken. I would actually recommend the same in most situations. I was just trying to make it so she would not have to post it for everyone.

You are wrong on many things. First, he does not have a first Shirt as he just joined. Second, unles she has a order for support there is nothing the shirt can do. If she has an order, she needs to do exactly as I stated.

Thanks guys. I do have a child support order from January 2005. If I attempt to get an order to withold pay from the court, will i have to attend a hearing (and in effect, need an attorney)? I was hoping to avoid that if necessary. Also, I don't have any type of garnishment memo from the court and someone mentioned this would be a problem. Is this correct, and if so, could you please elaborate?

Also...no, if he's in jail, he cannot pay me. But, I'm not getting support anyhow, so it doesn't make a difference to me at this point.
