The letter from the court tells me to bring my bank statements to the child support calculation conference. If neither I nor NCP bring bank statements will the conference be rescheduled? Are bank statements usually required for calculating support or is it just calculated from tax returns? Thanks

Golly, and here I thought that letters FROM THE COURT were TELLING folks to do stuff, not giving pleasant and helpful suggestions.

I would think that tax filings, W2s, etc. would be more "telling" than just bank statements. After all, bank statements can reflect inheritances, or earnings off income from years past, and may not reflect recent income. Bank statements can also reflect funds flowing in and out of accounts from a significant other, who is not obligated to support the child.

Why in the world would you disregard the orders of the court? If you don't have a bank account then oviously you can't bring statements...but otherwise, why not?

Plus, maryanns, if you want valid help, you MUST LIST YOUR STATE. Don't expect folks to go back through your old posts to find out info. I didn't...and won't.

State is Arizona. I'm sorry I didn't make myself clearer. When we first established child support in court last year the letter from the court said we were to bring our bank statements. I BROUGHT mine. He did not bring his and noone even mentioned it. That is why I am asking now about bank statements. My attorney did not ask me about supplying mine so I haven't sent it to him. He said it wasn't needed even though the court specifically states bank statements as one of the items required for the conference. I would very much like to see the NCP bank statements as I think he is hiding income. I was wondering if my attorney could reschedule when NCP doesn't have bank statement at conference. I am going to have my bank statements available during the conference. I just can't believe that the court says that bank statements are required yet no one asks to see them. I would like for my attorney to be able to continue the conference when NCP shows up without his statements. Is this reasonable?>

Even IF he brings his bank statement to court, YOU won't be getting a peek at it. Are you planning on handing over YOUR financial records to your ex?

And given your last LEGALLY INCORRECT RESPONSE you gave a poster previously, I am not surprised you asked such a stupid question. More proof people like you should simply lurk -- and not response to other posters.

I don't mind if he sees my bank statements and I don't mind if he sees mine. The court says we are both to bring bankstatements and I am asking you legal brains if the conference can be continued if he doesn't bring his. I guess noone knows the answer or they would post the correct answer for me.
And as for me, I have given no incorrect legal advice on this forum, thank you.

Yes, you have...Do you want me to copy and paste the post for you??

We can say if the judge will order a continuance...we are not mind readers, it could go either way.

Edit to add: This is the link to the thread, you had advised a woman to commit a fraud on the court. Mary deleted your post because you gave improper, illegal and just plain stupid advice! You were lucky that you didn't get banned! This is a great site that you could learn a lot from, if you have the brains to check your facts BEFORE commenting! ;)

Another quesiton regarding support calculation

AZ
If someone else pays your rent monthly (in my circumstance my father pays my rent), is this money counted as income when calculating support?

I apologize if I gave someone incorrect information. As I said before, I didn't tell the person to lie. I told her that before a paternity test was taken she did not know for sure if the guy was the father and she could tell the court she didn't know who the father was for sure. That isn't a lie.

Yes, right after SHE TOLD YOU that she did know who the father was, and that the father knew as well. That is encouraging someone to lie. Dress it up in all it's finery, and it's still the same thing.

Yes..it is! In the thread in question there was no doubt in the OP's mind about who the father is....You were trying to be cute....But advice like that, were the OP to follow it, could make some serious legal issues for her. Own what you did and don't do it again!

Ok, fine, I was wrong and I admit it.
Can I please have an answer to my question about whether or not my father paying my rent is included in child support calculation?
