child support due date

What is the name of your state? VT

custody order reads "father shall pay mother the sum of 900 dollars monthly in child support."

When an order is worded this way, when is the due date and/or when is a payment considered late?

I would think it would be due the 1st of each month . I would think over 5 days late is too many .

There could on occasion, be a circumstance beyond control , that one would be overly due , such as hospitalizations,Etc. , but generally you should be notified of such.

Although My Order stated Payments to commence on the 16th , the dt. after the hearing dt. of the 15th. So you might want to assume it from that time frame.

See I was thinking the opposite.. not sure on due date but the way I read it basically there isn't one.. however if it's not paid by the 1st of the following month it is late and then it can add up to arrearage.

Do the statutes say anything about when due dates normally are if not specified in order? Here, it's due the first of each month. Even though you may get paid weekly or biweekly and it's garnished from your pay, the payment to the CP only goes out once a month in the monthly sum that's due to them, not every time you get paid.

So, like Tigger said, the payment isn't considered late until the first of the following month roles around. The statutes say 30 days but CSE doesn't really consider it late until the first day of the following month.

I don't know if I'm wording this right at all. LOL Ok, let's say you were paying $900 a month and your payment is due Sept 1st. It's not considered late until Oct 1st.

I would think if it doesn't specify, then it would be due the first of each month but ya never know.

I think the bottom line however is that no one (legally) will consider it late until the first of the next month.

thats what I and the actual sender think, but try telling that to the receiver. LOL
