I have 3 kids who live with their mother. I have joint custody. One child has come to me to ask if she could come live with me due to constant fighting with her mother.
I would like to know, that if she does come to live with me, what would be the law about how much child support I would pay the mother, and if the mother would have to pay me child support. Would it just be a reduction of my support to their mother by the difference in my 30% and her 20%?

Thanks

You are required to continue paying the full amount shown in your court order.. unless/until you get a court order changing it.

I know that

I know that... what are the laws on child support about multiple children in different households? Will there be a change if one comes to live with me?

Yes, there would be a change, IF one child came to live with you. CS would be figured for each parent separately. Then, if the amounts differ, the parent with the higher obligation pays the difference. However, worrying about support for a hypothetical situation is putting the cart in front of the horse.

thank you

thank you...
It may never happen, but I an trying to figure out some things in my head BEFORE it happens, so I would have an idea on what to expect if it does happen...
Will have to go to atty for this one for sure, but just wanted an idea before...

And of course, that is NOT true!!!

The child support COULD be changed... but you can't just 'renegotiate' it on your own and supercede an existing court order. Unless either of you file for, and get an order as such, you are still obligated to follow the original order.

You could most likely handle a support modification without an attorney. Unless wither of you has a net monthly income greater then $6000, the guidelines are fairly black and white. For a custody modification, an attorney would definitely be the way to go. Although the child's preference is normally taken into consideration if the child is over 12 years of age, when the modification would mean separating siblings, it gets more complicated.

the child is...

The child is 17. I WILL be going to the atty for any modification. I just wanted to get a feel for what to expect. I have already found out that her mother cut her cell phone off and is keeping her car because of this... She only had 150 dollars left to pay her mother back for the car, and her mother said she can't take it with her whether or not she would finish paying... I know it is irrelavent, but it just pisses me off to no end as to how vindictive she can be.

Okay... lets try this ONE MORE TIME....
NO.... you can transfer your kids around amongst yourselves all you want. It will have NO impact or change on your COURT ORDERED child support order.
Heck, if the court order grants custody to your ex... and orders you to pay child support, you can MUTUALLY agree that you will take all the kids... and you are still legally obligated to pay her. It makes NO difference to the ordered child support.

It's highly unlikely that a custody modification that is not agreed upon by both parties will make it through the court before the child turns 18.
