What is the name of your state? Tx.

I have looked around and can't seem to find anything specificly related to my question:

My husbands ex wife has filed for a child support modification. It has been 5 years since the divorce. He has never been late, and is current with his payments. He is not in arears. My question is since their divorce he has gotten a few better jobs, better pay. This past year, however, he took a job that pays much less. He is still paying the correct amount of support, in hopes to achieve a raise in the future.
Based on what I have written, when he goes to court, will the judge make him pay support based on the jobs he had before this last one? or will it be calculated at the pay rate he is currently working? Also, it is in the same field of work.
Thank you

If he quit a job to take a lower paying job, it *could* be based off of what he would normally make. If he did not quit with the intentions of getting lower pay, it *could* be left or lowered.

NOt really great answers, I know...but nobody can tell you what a judge will do. If support is higher/lower according to the current guidelines a judge will probably follow them.

He lost his higher paying job, was out of work for a month and took the lower paying job as it was the only thing available at that moment. however, it is with a great company, with good working standards, and my husband loves his job for a change. No weekends, no outragous (mandatory) over time, and the people are nice. My point is he likes his new job and I don't think he will be leaving. (To return to the jobs he hates just for the money) It is so hard to find jobs right now, He was out of work for a month, that just about killed us. If he were to look for another job it could take months, maybe even a year to find one at his previous salary.
Any way, thanks for your input.

Will the judge make him pay the difference, of what he could have been paying had the support been adjusted to his higher income? (retro)

***Not likely, but realize the court system is a mess and anything can happen.
