I live in the state of Texas and am a female non-custodial parent. My ex-husband lives in the state of North Carolina and opened a child support case in the County he lives in, because I owed back child support at that time.
We were divorced in the state of Ohio where I was court ordered to pay child support and have payed all of my back child support up to date. Balance is $0. The problem is that for the past 3 years the state of Texas says that I owe them over $7,000 dollar in back child support and the only way that I can get them off of my back is to have my ex-husband write North Carolina a letter stating that I do pay child support and to close the case in North Carolina and Texas. He knows that if I file my taxes he will still get my refund check because Texas says I owe back child support and it will be sent to him. He doesn't want to close the case so he can get my refund check. Attorney General office is no help to me at all! Who can I contact to get help. I don't have much money for a attorney. And cannot afford to fly back and forth.

You should be contacting the state you were paying your support through and getting certified pay records from that court to provide to the state he is filing in of the amount that was paid and showing the balance due and dates. The state he lives in cannot collect support from you that has already been paid if you are paid up to date, unless they have established a new order which has been known to happen over the years. But it is your responsiblity to get this verified information to his state since it is your order and your money they are after. Better hurry before they give him your money, because if they do and he spends it you could be fighting him in court to get it back.

Your nightmare and ours

It was good to see another non custodial parent who has the same situation we do. We live in Idaho but are having trouble with California and the custodial parent who is doing the same thing as yours. Problem with ours is Calif is charging interest of $30,000 and building at 10% per month!!There are arrears from the welfare that Mom collected and our statements from Idaho say $9,000. Have you gotten any advice or info to help you? If so please let us know! The attorney general here in Idaho tried to help us but California has not responded. Thanks, Tracey Doyle Mrs. NCP
