child support order out of state

Michigan. Ok I will try and make this short. I live in Michigan, my 16 year old son went to stay with dad for school year in Indiana. I pay for all of the insurance coverage on our son. Dad has just been accepted on disability for health issues and is on Medicaid first. In August when our son went to stay with him dad signed him up for medicaid in Indiana. In September he stopped the child support that he paid me through FOC so it is suspended but dad owes me $1,386 from the prior year and a half before our son went down there to stay. He sent me a letter saying that when he signed our son up on Medicaid that Indiana asked him if I paid child support and he told them no so he said they may be coming after me for support and he can't do anything about it. We still have an open order in Michigan even though it is suspended for now. Our son living with him is on a trial basis for now. Can Indiana try and get child support out of me with our order in Michigan and Dad still owing back support? Can dad put son on Medicaid in Indiana as secondary? I send my son money and clothes that I have bought for him but I don't send any to dad. That was by dad's request. Dad gets more money by himself then me a month on disability and he gets our sons portion which is $100 more then his order a month to pay me.

When the child went to stay with Dad, was the order ever officially changed through the court?

It doesn't matter if the child is there on a "trial basis" (WTF is THAT anyway..."trial basis"...what is your child? A piece of exercise equipment?? :rolleyes: ).

If the dad can prove that the child is living with him, the state will go after you for repayment. There isn't anything he can do about it. Since he is collecting disability, he's obviously eligible for Medicare, so whatever the primary insurance doesn't pick up, medicare will.

Why was it suspended? Because he is now living with dad? You shouldn't be collecting if he's not with you.

You can try collecting on arrears .

What has most likely been suspended is ongoing child support obligations .

Call SSA and explain you have a CS order , and you are owed arrears , up until the CS obligations were suspended , and you'd like to know how to collect off his benefits .

And yes , that State will want reimbursement from you .

What you gave to your child are Gifts , and can not be used for official CS payments .

First of all NO my child is not a piece of exercise equipment and thank you for assuming!
Our son and his father have always had a very strained relationship and my son wanted to "try" living with his dad. His other two half brothers have moved away and he thought that maybe his dad would have time for him now.
Dad is the one that contacted FOC to suspend child support and told them he didn't want any from me. So that is why I give my son "gifts" so that his dad doesnt have the whole burden of buying school supplies, clothes, etc. Even if I sent Dad a check it is my understand that FOC wouldn't count that as Child Support either.
If I have our son covered on my insurance, his dad can have Medicaid as secondary and I will have to pay that back?? So I am paying all of the insurance premiums, my portion of uninsured medical and going to have to pay back the state of Indiana what they have paid on him as secondary? And I have no choice in the matter about the secondary?
Yes he owes me for back child support for the last year and a half prior to our son going to live with him.
