What is the name of your state? TX**************.....I have several questions in regards to chi;d support. 1st**************.my husbands ex wife has told him that he will get a review on his child support in june**************..when she has told him in the past that she did not want a review. 2nd....His main concern is that he hardly see's his daughter****************************.what it really comes down to is**************the ex wife is going through another divorce again and so she wants to make my husband unhappy now, when she stated a few months ago she did not want any more money. Ok**************..here is the question****************************should my husband get an atty? Does the attorney general take in consideration on the bills that you have or is it just off the gross annually income? Thanks
 


In the state of Texas, the OAG reviews cs every 3 years. They do not take in to consideration of your monthly bills...you can google Texas Child Support calculator and see what to expect. I am sure that his ex is not trying to make this personal to your family..divorce is stress enough. If she is going through yet another one...I am sure that is what it is. ;)

Net income (after taxes and a few other deductions)

(d) The court shall deduct the following items from
resources to determine the net resources available for child
support:
(1) social security taxes;
(2) federal income tax based on the tax rate for a
single person claiming one personal exemption and the standard
deduction;
(3) state income tax;
(4) union dues; and
(5) expenses for the cost of health insurance or cash
medical support for the obligor's child ordered by the court under
Section 154.182.

She is within her right to ask for a review even if she has stated that she doesn't want one.

OAG doesn't automatically review every 3 years, if i'm remembering correctly they sent me a letter at the 3 year mark with the forms to request a review. Once requested they will determine whether there is enough change in circumstance to grant an adjustment.

If dad hasn't seen his child, he SHOULD have been taking those issues to court seperately. OAG doesn't get involved in visitation issues.
