What is the name of your state? GA, children live with Father in CA. I have 7 children, 2 live in CA with father. I don't work because it's far cheaper for me to stay home then have my kids in Daycare. The father of the 2 is sueing me for $12,000. He's known I don't work, but is persuing c/s when he at one time said he didn't want it. Can c/s be included in a bankruptsy? Is there any way around this?

What are the ages of the children, with you & with ex?
Are all 7 children the ex or different fathers, if so how many by each?
Are there C/S orders in place and what is the status?
How do you make your income if you don't work?

We need more information to answer questions

CS cannot be included in bankruptcy. Your children - all of them - deserve your support. Is it safe to assume that the other 5 children are from (a) different father(s)? Whom you receive child support for? Or is it state aid? Regardless, it is your responsibility to help support your kids. And the father in CA is perfectly correct to hold you to that responsibility. There are jobs you can do from home, there are part-time jobs you can take that will work around the childrens' school schedules, etc. Time for you to get work of some sort and stop being a deadbeat. And for God's sake - get fixed and stop popping out the babies.

If he has two of your children, he is entitled to CS for them. Obviously any other children of his that are with you can be balanced against that obligation, as he's responsible for helping you support any children of his that are with you.

However, if these children are NOT his, you have no right to decide you don't have any obligation to help support your kids. Just as he can't use children of another relationship as an excuse to not support his kids, neither can you.

Many on this forum are fond of the expression "if you can't afford to support the children you already have, you should not have any more".

If male NCPs who to choose to not work to instead be SAHPs with children from subsequent relationships still must pay CS, then the same is true of female NCPs who choose to be SAHPs because of children from subsequent relationships.

I'd like to know how old these kids are - all of them - and which are the ones with their father. I'll admit to having a certain degree of sympathy for a parent who chooses to have a subsequent child and has trouble supporting the previous ones. But, 7 kids? Come on, already. That is truly a case of "if you can't afford to raise 'em, quit producing them."

If there was no previous child support order then he is not going to get the $12,000 arrearages he is asking for. However you will be ordered to pay child support on an ongoing basis. However, based on the fact that you don't work and have 5 other children, it will probably be a fairly minimal amount.

If there was a previous child support order made, then you WILL have to eventually pay that $12,000. What is most likely to happen is that an amount will get added to your current support to go towards that.
