Hi
I'am a father of a child who is about to turn 18. I've been paying my support for 18 years and I'm not behind. Although my exwife is trying despertly trying to get an extension and an increase in my child support. she is trying to get me served to appear in court on this matter. There has been 1 attempt to get me served and i dodged them.My son was in school but dropped out becasue he was failing.i later find out that he is back in school. What is the law here? Should i continue to dodge them although I have 1 child support payment left. And he turns 18 the end of Janurary. I have 30 days left. what can happen to me legally. My ex just got her 6th divorce, imagine that nobody wants her. Any way she has no-one she can fall back on for anything,eg alimony, support for other kids or anything else but me. what are my rights and whats the Law. Can she come after me like this and if so what can i do to stop it from happening.

Before anyone can give you any kind of advice, we'll need: your state.

General Answer: If your son doesn't continue his education (college) then you have no worries. The only other issue at hand is if he is still in school, then you most likely will pay until he graduates.

Look at your support orders, what do they say? "Becomes 18, or leaves (graduates) school, whichever comes first" SHOULD BE ON THERE SOMEWHERE.

THERE IS NO STATMENT IN MY DIVORCE DECREE THAT STATES HIS AGE CHILD SUPPORTS STOP.

LOUSIANA STATE LAW STATES UNTIL THIER 18.

THEN GO BY THE LAW, BUT IF HE CONTINUES HIS EDUCATION, AND IS LIVING WITH HER, YOU CAN BET YOUR SWEET @$$ SHE WILL BE TAKING YOU TO COURT FOR ADDITIONAL SUPPORT AND COSTS.
