I talked to OAG about my child support case that has been pending since March of 09. They stated that ex and I would need to go to court since When I gained custody I wasn't requesting child support. Things have changed since that time. My sons Mom has moved to another state at the time she had custody of another child (by someone else) and I didn't want to affect her providing for this child. She has since given custody of that child to his father and gotten married. She gave up other child in January and got married in Feb. and I filed in March. Then in August she quit her job to move with her husband who is in the military. From what I know she is not working but it is not because she cant. She is now attending school and other than that she chooses to not work. Is it possible to ask that they imput (dont know if that is how that word is spelled) an income for her based on her ability to earn? Any help would be greatly appreciated.

Yes, mom has an obligation to support her kids. You can definitely file for child support and they can put in an income for mom. Mom should not be exempt from paying, you deserve the support so file.
