What is the name of your state? California

New to this, need info. on young children who can't talk in auto accident. Don't have an attorney, both paties have insurance, other party (not me) found to be at fault. Rear ended.

Children "appear" to be find, but am concerned something may come up. Doctor say may be o.k. but no one can give me a definite answer.

Have been advised not to sign release of medical (I think that is what it is called)

What is the compensation for the children? Should I get attorney. Am injured but not very badly.

Any info. appreciated.:o

My husband and my mom told me to see an attorney, but no one else...the problem is if I get an attorney I know that I will have to keep going to the doctor on a lein..

Right now I go under my own insurance from job....

Just want to know what to do that is best for my family

Yours and your children's medical bills should be covered by your auto insurance, provided that CA is a no-fault state (which I'm guessing it is) and you have first party medical benefits on your policy. This is the case whether you get an attorney or not (which you should). Your health insurance is not responsible if your have the coverage on your auto since that is considered the primary coverage for an auto accident. You should let them know which bills are from the auto accident, they will want to be reimbursed by your auto coverage.

Thank you for this advice!!!! Now what about the point that my children can't speak for themselves? And wouldn't I have to go to the doctor over and over again?

Is it too late to get an attorney, it's been a couple of weeks....

Why can't your children speak for themselves? You've already stated they don't have any injuries. How severe was the crash? Why are you concerned something may come up if they appear fine?

Why do you think you need an attorney? The other party was found at fault, so submit your medical bills to the other party's insurance company.

My response:

California is a "fault" State. We threw out "No-Fault" when it was on the ballot because Californian's know better. We knew that it was an "insurance company con game."

I didn't bother responding any further to this writer because I deemed that it would be fruitless. She already has her mind made up due to her own misunderstandings and ignorance.

So, I wasn't going to waste my time trying to convince her otherwise.

Wow. Well in that case the other people's auto insurance should cover the medical bills, right?

How fast was the other person going when they hit you? Are you injured? Kids are generally more resilient then adults for this kind of thing, they might actually be fine, especially if they were in the proper child restraint seats. My aunt was in a car accident with her daughter when she was very young, but it was obvious right away that there were injuries. Just watch them closely to see if they are moving any differently.

Hi, to Teflon Jones, I had posted previously that my children CAN'T speak. Only the 4 year old can and the 2 , 1 year olds can not. I don't beleive that I need to explain why they can't any further. One of the 1 year olds keeps crying and no longer sleeps well. I was informed by pediatrician that she is traumatized. She doesn't want to go into the car, she screams at night, etc....that is why I say they "appear" to be alright.

My 4 year old says he is fine, and the other 1 year old "appears" fine. But I received advice from another parent who was in an auto accident with small children like my own to not sign off on the medical too soon because you never know.

At teh time of the accident the one year old that is having problems would notstop screaming and I was told that she was "scared" from all the noise of the accident and the motion from the collision. I was hit by a rather large truck and I was in a small sedan.

Oh, by the way the person drving the other vehicle at first tried to lie but it was later found that she was lieing.

Hope this sheds some light on the situation.
 
I don't mean to sound stupid or impertanant but how do you buckle 4 children in the backseat in properly restrained car seats in the back of a sedan. None of those children were old enough to be out of a carseat and they shouldn't have been in the front either.
 
and for helpfull info: My friend was driving and involved in a car accident with her then 1 and 3 year old. They were traumatized at first and didn't want to get in the car. The younger one had bad dreams for months. The children grew out of it and the mother was far more upset about it than the kids who didn't rember it 2 years later. Kids are resilliant. If you are worried take them to a specialist like recommended.
