My wife is Chinese and I'm American. We live in Michigan, have been married for more than 11 years and have a 7 and 8 year-old son. She was absent from the our home for more than 6 months during the year 2000 and I have been the primary caregiver to our 7 and 8 year-old sons. I filed for divorce in Sept. and served her in Florida. My wife travels extensively and recently returned from Miami, Fla where she was sharing an appartment with a divoced male business partner of hers since October. Upon her return to Michigan, she insisted that she wishes to return to China and will take the boys to China for good. She is highly disruptive to our core family unit whenever she chooses to return to our Michigan home and our 8 year-old does not want her to move back in. Our 7 year-old may feel the same but he is autistic and communication is always a challenge. Our divorce won't be final until March 2001. I need to know if there is some type of legal document I can serve her with that will prevent her from having access to the marital home. She seems to enjoy disrupting what has been a stable, warm family environment in her absence. But more importantly poses a significant threat to kidnap our sons and flee to China where U.S. law has no authority. Thanx in advance...
