What is the name of your state (only U.S. law)? NY
Hello, so I was pulled over after someone called in, and the officer was very unprofessional to the point of yelling, after refusing to talk to him I talked to a different officer who arrived on the scene and after he left the original officer gave me a citation under 1124. I was on I90 at the time, and have read somewhere on this forum that under the statute 1124 specifically only applies to two-way roads. I was wondering if someone would be kind enough to clarify where is states that (preferable a link as I can't seem to find that anywhere), and weather or not I should fight this, which if true that it only applies to two-way traffic I'm assuming I should.

Well gee, last time I checked ALL interstates ARE two-way roads, so how is that relevant?

I was wondering if someone would be kind enough to clarify where is states that (preferable a link as I can't seem to find that anywhere)

If you can't find the statute and read it, I don't know what to say. Google New York Vehicle and Traffic Law and then look for the section.

New York Vehicle and Traffic section 1124 applies to those passing on the left side of the CENTER of the roadway. Here is a link: http://law.onecle.com/new-york/vehicle-traffic/VAT01124_1124.html

If I-90 was a divided highway where you were stopped (and I don't know of any section where it isn't), it appears you might have been cited for the wrong offense.

Why do you think someone called in your vehicle? What were you doing that attracted attention and made the officer so angry? Was there construction on that part of the highway?



edit to add: The thread from 2012 you mentioned in your post (https://forum.freeadvice.com/speeding-other-moving-violations-13/nys-vtl-1124-ticket-585104.html) had advice offered by HighwayMan to that poster that sounds like it could be good advice for you, as well (depending on all of the specifics of your stop).

Another edit to add: HighwayMan makes an observation in his post below mine that makes a lot of sense.

I often find that people think we're angry when we raise our voices on a vehicle stop on the side of the road, especially a highway where the noise level is high. It's usually done to ensure we can be heard by the motorist. People always jump to conclusions very easily. I'm not saying that's the case here, just putting it out there.
