What is the name of your state (only U.S. law)?
Hi,

I live in South Orange County, California and I was cited this afternoon for "failure to stop for a crossing guard" (CVC 2815).

I'm a VERY careful driver when picking up my kids from school. I was not speeding and had just pulled from the curb to join traffic through the intersection. The front of my car was at the yellow line when the crossing guard stepped off the curb two lanes away on my left. I didn't see her step down because I was passing through an intersection and looking straight at the time. (She was also blocked from my view by a truck passing at the same time I was approaching the crosswalk.)

The officer has a tiny video of the violation and it looks like a really close call to me. Any advice on whether to fight this or not? I don't think this type of citation is Traffic School eligible?

The violation is not traffic school eligible. In those instances, I say fight it. You're in no worse position if you lose. If you win, you're off the hook.

I just had the same scenario happen to me yesterday where I received a ticket for VC2815. I'm curious how your case went, if you fought the ticket and what happened in court?

You mentioned the officer had a video, how were you able to see that video? After the officer gave me the ticket, I said I would fight it in court, and he said he got it on camera. I would like to see that to see if what I think happened is worth fighting.

Also, they say your insurance will go up approx. $1000, is this true? I have nothing on my record.

You'll have to plead not guilty to see the video.

Also, they say your insurance will go up approx. $1000, is this true?

Depends on the insurance company and your rates. Some companies don't surcharge for the first citation, others surcharge an average of 10% to 25%. The big surcharges come from at-fault accidents.
