I posted this same message in the forum of juvenile law because I didn't know where it belonged. Civil rights or juvenile????
Here is my question. Do we have grounds to sue the deputy and county? For what... police misconduct? assault on a juvenile? maliscious prosecution? violation of civil rights?
In short: My 16 yr old and his 2 friends made several written complaints of harrassment against a particular cop in (particular city), MO because he stopped them without reason many times, cussed at them, made them leave public property without cause while allowing other people to stay there. The written complaints were ignored. My 16 yr old walked into the County sheriff's dept (in same city)to ask a question. He was cussed and told to leave. A deputy called him a dumb f##ker. My son called him a crooked cop. The deputy took my son into the bathroom and said "I'll show you a crooked cop". Another deputy and the officer the complaints were written about were in the bathroom, too. The deputy hit my son in the stomach and held him against the wall with his fist. He put a mace can in my son's mouth and made my juvenile son call him sir. Then the deputy sat my 16 yr old son in the hall of the County sheriff's dept (pushing him into the chair causing my son to hit his head on the wall) and several times pointed the mace can at my son asking "what's my name?" and making my son call him sir in front of everyone. Then he let my son leave. Now there are some trumped up charges against my son and the officer that was in the bathroom (and is also the same one who the complaints have been written about) has given a statement against my son concerning the crime. His wife did too and their statements don't match. The charges are disproportionate to the alleged act. When an officer sees my son he pulls over the car. My son has been in trouble only once before. At age 13 he broke a window in a car at a scrap yard. We have a public defender for the alleged act and he told us he thinks we have a case against the deputy and county on the incident I described to you. As part of our suit we want reform and a community committee set up to police the police. The county is abusing authority. They posted a $15,000.00 cash only bond for someone accused of cutting a tire. That's just one example of many. Do we have a case? How do we proceed?
