Civil Rights issue?

Hello,

I am trying to find help with a legal matter. My father used my information to take control of domain names of mine. He also took all of my possessions from a house that I was renting from him. He has also kept possessions of mine that were located at his office where I was working for him.

I did file police reports and the police detective refused to even ask any questions or investigate anything about these incidents. The detective only told me a few weeks later that it was a civil matter. I also contacted the city prosecutor who took my information and stated that he would send a letter to my father. Nothing further has been done regarding this by the city.

I was wondering if there would be a civil rights issue with the city because they failed to investigate the police reports.

A: Which civil rights do you claim were violated and why?

You probably mean something like a writ of mandamus instead of a civil rights violation? Problem with that is that I believe police investigations and prosecutions are discretionary and discretionary acts are protected from a writ of mandamus.

I was just referring to victims rights by the prosecutor and police. I will have to look up the writ of mandamus.

This is a civil matter.

I realize that there would be a civil case. I would have liked the police department to have made a few simple phone calls to find out that my father did indeed use my identity to obtain the domain names. I thought it would have been some form of identity theft.

I also thought that there would have been some sort of theft charge since he went into the house and took everything, even the light bulbs.

If this happened in the city limits, is there any way that the sheriff's department may have any jurisdiction?

Let's make this real simple. Let's rate crimes on a scale of 1 to 100. Something like premeditated murder would be 100. Robbing a bank with a gun would be about 60. Beating someone up would be about 30. Stealing a candy bar from a store would be a 2. The crime against you is about a 1. The cost to investigate and prosecute this would far exceed the benefit to society. That is why we have laws to seek redress through the courts for our losses, those courts are called civil courts. The sheriff from outside the jurisdiction can do nothing for you. All they will tell you is that it is a civil matter. Go talk to a local attorney, most give free consultations, and you will be given the options for dealing with this case.

That would also have put the police on the wrong side of an additional civil suit.
