I think based on the information provided in the post, it was not silly - albeit a tad wild, and admittedly a guess.

I admit my "advice" was a silly wild guess and definitely premature and, based on the usual postings we receive here, LeeHarveyBlotto's guess is far better than mine. :)

But, I imagine the ACLU will let claypotter know that. ;)

The ACLU is not all that helpful these days, unless they actually decide to take on a case. So most inquiries to the ACLU will not get a response. A quote from their website:

If the ACLU does not accept your case, we cannot provide legal advice
If the ACLU is not able to provide legal assistance, we also cannot provide legal advice about your case. We won’t be able to answer questions about the legal significance of the facts, conduct legal research, or provide information about the legal deadlines that might apply to your situation. This policy allows us to direct our limited resources to the cases that we do accept.
