Texas, pregnant given drug test without knowledge before delivery, positive result. Turned over to cps. Lost custody of child,Since the S.C. has ruled violation of civil rights, to test just for the purpose of turning over to law enforcement. Can I sue the hospital, cps. Do I have a chance in court. I can't even see my child. Please let me know if I am understanding the law correctly, and also let me know what the law is concerning this in Texas.

The testing of women who are about to deliver has never been challenged in the Supreme Court. In my state, it is the law that women will be tested for drugs. And it is against the law to subject unborn child to illegal drugs. If you did drugs while pregnant, the law did what it was suppose to do. Other than abortion, do drugs while pregnant is has to be the cruelest thing that can happen to an unborn child. I would suggest you talk to a local attorney familiar with your situation, if you can find one.
