Husband claimed myself and my son(not his biological son) through the VA as dependents for benefits as well as our daughter in 1994 without my knowledge.
Left him and took the two children with me in 1996 and divorced him in 1998.
He recieved a lump sum of money from the VA and continued to collect on me (without my knowledge)until 1998 and my son until now 2001 when I found out he was doing this.
I contacted the VA and I was told by this agency that they did NOT need my signature or consent permission etc. for this man to claim me or my son.
Feel raped by the system...This man used my name and the name of my son to profit and I know he is responsible for fraud BUT I feel that this government agency is also responsible for not allowing me to have knowledge or consent .Is is possible to sue the VA in order for them to change policies that would allow all parties being claimed as dependents to be duly notified and require a signature.
I feel as though I had no rights with the VA concerning myself and my son..
Please help.

My response:

Sure you can. As a taxpayer, you have every right, and duty, to redress your government for your grievences.

Just fill out and file your Federal Claim form and, when that is rejected (they always reject the claims), then file your lawsuit in a court of competent jurisdiction.

One last note : Make sure you have a boatload of money to do this.

Federal Claim Forms?

Thank you for your answer!
I have only a couple of further questions...
1.
What is a Federal Claim Form and where would I obtain one?
2.
What kind of attorney will I need to seek out in order to see if I possibly have a case?
3.
Is it likely that some attorneys or legal aid may take this case on contingency seeing that I don't have a boatload of money?
