What is the name of your state (only U.S. law)? kentucky I have 4 children my x claims 2 I claim 2 on taxes this whole year they have been with him 2 times 4 days he pays no child support I want to know if I can claim all of them on taxes.he is supposed to pay 8oo a month but dont

What does your court order state? Is the ex ordered to pay support??

IM sorry I thought i made that clear he is supposed to claim 2 im supposed to claim 2 that is on joint custody he does not get them

If you are using a cell phone to post then you might want to consider finding a computer with a keyboard so that you can answer more fully.

We want to know exactly what it says, word for word. If there are any conditions attached to his claiming the children that might give you some options.

it says the parties agree that as long as both parties are working the husband shall claim zach and katie the wife shall claim patrick ansd sarah each and every year for the state and federal tax exemption

Then you would have to take it back to court to get that changed. You should also be taking him back to court for contempt for the non-payment of child support.

I tried to take him back to cort he took a contractor job out of the country and i cant get any info on him the child support division says there is nothing i can do his mony is through the caymen islands.

Then you file to change who can claim the exemptions for the children.

However, if he is one of those scofflaws who is not filing a tax return because his money is offshore, you might be able to go ahead and claim all 4 children, because under the federal tax code you are the only one allowed to claim the children. Its the state court judge you have to worry about.

However, you would also need to make sure that it really gives you a significant benefit to claim all 4 children.
