closing nightmare

Ok, we sold our house, we accepted the offer 2 months ago, a closing date was agreed upon (april 20 - this was mentioned after it took 2 weeks for the inspector to return the inspection report) and now the buyers attorney can't make it due to she's on vacation so the closing has to be postponed until the following week.

According to the buyers attorney's office there is no one else in the office that can do a closing.

is there anything we can do on this or no, do we just have to wait until the week of the 24 to finally go to closing?

Just an FYI: this has been a sell from hell, with their agent doing some unethicnal things, from a shady home inspector, to now this attorney on vacation bit.

Make sure all parties sign an extension addendum to the 24th. Not sure about the unethical stuff or the shady home inspector. Are you asking for advice on that too? If so, please explain.

Why is it unethical for the attorney to be on vacation?

Although, in our office, there is ALWAYS closing staff available to close, as long as the closing is desired during regular business hours.

Some title companies will close deals that they have had nothing to do with.

If that is okay with your buyers, then have it. But they will probably want their own attorney to do it.

That is CRAP!

An attorney (of all people) should know that if a closing date is specified in the contract, they're bound to it! Tell the agent that you want to go to closing on/before 4/20. Inform them that if the seller cannot carry through the contract by the terms contained therein, they will be in default. Light a fire under their arrogant can!

If the attorney knew s/he was going to be on vacation, why not designate an alternate?

I call shenannigans on their part.
