I'm my mother's only heir. She was "joint owners" with my daughter on a co-op. We found a buyer for the co-op before the will was probated. The co-op lawyer refused to allow the sale because "joint owners" (the phase that the co-op personnel wrote on the oringinal document) is not a correct legal term. The co-op lawyer and my lawyer agreed to allow the sale to proceed only if $50,000 from the sale was put into escrow until the will was probated. Here's the problem. Now that the will has been probated my lawyer contacted the other lawyer to release the $$ to me. The co-op lawyer sent her a copy of the 1 paragraph document she agreed to. It states that the $$ will be held in escrow for 9 months after the date of probate....I'm angry that my lawyer didn't notice the 9 months part of the agreement and even angrier that the money (which all parties know I have refused claim to and which will go to my daughter) will not be available until nearly a year after the sale of the co-op. Is there any way I can get the $$ sooner?
