What is the name of your state? CA

So I sued the schmuck to hit me without insurance and won, however I know he is not going to pay (or be able to pay) the whole amount within the 30 days, so what options do I have?

I'm also afraid that he is working for cash so I won't be able to get the money from his paycheck..

What options do I have?

How can he be forced to pay?

My response:

Well, the first thing to do after the expiration of the 30 days is to set up a "Debtor's Hearing". Once that's set, and he's served with those orders, then serve him with a set of Asset Interrogatories.

I guess I'm curious what will happen if there is nothing to take from him (no paycheck, no bank account)..

MY RESPONSE: No. This is strictly a Civil matter. "Debtor's Prison" was abolished in this country over a century ago.

MY RESPONSE: Well, then you get to do what THOUSANDS of people do . . . use your judgment papers as wallpaper. However, a judgment in California is good for 10 years, and renewable for another 10 years. So, the likelihood is that sometime within 20 years the judgment debtor will have something to go after. Also, you can set up a Debtor's Hearing every year to find out what he's got that can be taken, attached, or levied against.

MY RESPONSE: Unless you're a female, 5'6" to 5'10", and have flowing, natural, red hair, weigh no more than 135 lbs, then I must respectfully decline. I get this type of offer all the time, and I never accept. So, please, don't take my declination as a personal affront.

I can attest to that Spawn_X.

I even went so far as to buy the red wig, Walk on my knees and lose 100 lbs but no dice...couldn't get rid of the beard:(

:) nothing personal taken IAAL. i hang out on other boards (mostly off-road) and meet people all the time so i'm used to that.

One more question..

How can I use the judgement to suspend his license?

I'm sure that he never got his license suspended after the police report because he probably came up with some fake information and/or friend's phone number.

However now that I have the judgement how can I enforce it?

I also remember reading somewhere about his license being suspended until the judgement is payed off.. Any truth to that?
