Collection Calls

How many times a day can a collection agency legally call your home ??
A certain collection company has been calling me up to six times a day for the past month. When I answer these phone calls, they hang up. Since the number appears on my Caller ID, I phoned them back, and asked to speak to a supervisor / manager. I explained that I was getting a little tired of this game, and felt it constituted harrassment.The manager stated "WE did not call you -- you called us".
I told her that I have been keeping a record of the number of calls per day, and would contact appropraite agencies if the harrassment continued. Now they call and block their phone number. When I called them back again, I told the manager that this was unethical, and she began a tirade , screaming at me, asking if I was refusing to pay the bill . . .

I will admit that I do owe for the debt they are attempting to collect, but will refuse to pay it until these calls cease. I informed her of this, telling her that as long as this particular company was the collector, I'd never pay. She claimed the bill would be turned over to "Collections", to which I responded, " If YOU aren't COLLECTIONS, then who is ? "

My question: What can I do to stop these people from calling ( other than paying, obviously ) and do I have any recourse if they continue to call and disconnect so many times a day ?

I've already sent them a letter( googled their address ) documenting the calls, stating that their BS wasn't going to get the bill paid any sooner ! .. I have also informed them in writting that all further calls will be recorded.
 


Search on Google for the Fair Debt Collections Practices Act. It outlines what is and isn't legal when a debt collector is attempting to collect a debt. It doesn't just apply to collection agencies, but to anyone who is attempting to collect on a debt. At the very least, you will be able to send them a letter asking them to cease communication by telephone and send all further correspondence by mail instead.

NOT TRUE!!
The FDCPA ONLY applies to 3rd party debt collectors.

At the very least, you will be able to send them a letter asking them to cease communication by telephone and send all further correspondence by mail instead.
Also, not true.
The debtor has several legal rights.... and that is NOT one of them.

Under the FDCPA you can send the debt collection agcy. a letter telling them that you don't want to be contacted anymore except to let you know of any further action they intend to take to collect the debt from you. The debt. coll. agcy. must honor your request.

And THAT is correct. It is called a 'cease and desist' letter. A sample can be found online at www.creditinfocenter.com/forms/

This is the Federal Trade Commission's site with all the statues set forth by the FDCPA. It is much easier to find the pertinant information here, rather than navigating the commercial site linked above.
The 'site above' is NOT a commercial site needing to be 'navigated'. It is a simple site to FORMS!!!

Since you were able to find the FTC link to the FDCPA, how about your providing the EXACT link to the part where it says that a debtor can send a "letter asking them to cease communication by telephone and send all further correspondence by mail instead."

Creditinfocenter is a FORUM for individuals to go and ask credit-related questions, and we have a large section for collections. We also provide sample letters and such to help people with things like debt validation letters and credit disputes. The site owner provides tons of information and abides by the CROA laws as part of HER business, but the heart of the site is the forums.. just like this one.

Just curious.... who is the 'we' in your statement. Do you have an ownership interest in 'creditinfocenter'??
Also, the link referred to in the previous post (provided by me) was ONLY to the forms section of the website... NOT to the forums!!

I have no 'ownership' but I am a long-standing member there, hence the collective 'we'.

So ?? I was just explaining more about creditinfocenter.com and it's nature as a non-commercial site. :D
