Collection Of Chargeback Where Merchant Failed To Respond To Retrieval Request

Merchant threatening collection for unauthorized amounts. Visa sent merchant retrieval request and they failed to respond or dispute the chargeback.

My guess because the charges were fraudulent and they would incriminate themselves.

Now they want the amount that was permanently chargedback from me.

If they failed to provide the proof of charges to visa, when they had the opportunity can the amount be considered debt now?

I thought it had already been proven that the charges were unauthorized.

Please advise

Can't find anything under business or collection law.

It'll most likely go to collections. You're tone tells me that this was for a transaction you authorized and regret -- probably internet gambling.

What will happen? Who knows. I don't think that whole legal mess has shaken out yet. But your character shines out clearly.

Unfortunately your post does not answer my question.

If this unknown merchant had information regarding the transaction, why didn't they provide it? I believe consumers have a right to known what they are being charged for and by whom.

Since you have knowledge of collection laws, what are the chances of collecting a debt that has already been investigated and for which the company submitting the charge chose not to reply to or dispute, and for which they will not have any information to support the charge?

I am sure some unscrupulous collection agency will attempt some form of intimidation in hope that I am not knowledgeable of the law. However, that is all they will be able to do. It is no longer credit card debt. Correct?

By the way, my Husband and I have been in business for over 25 years and accept visa and mastercard so I am fairly familiar with the rules, although we have never had a chargeback.

good... But I still believe there is quite a bit information regarding the debt that you left out. If it is a stolen card, you should have canceled the card. Since that isn't the case, I can only assume that you have a business relationship with the biller.

Any number of 1,000 reasons. The person who handles that is on vacation; they had an emergency...

The collection agency doesn't care. As an individual debt, the chances of collecting any debt are low. As part of portfolio, there is a good rate of return.

Good question. Perhaps one of the lawyers on the site will split hairs as to the type of debt it is -- it doesn't matter to the collector.

Investigated Chargeback-visa Check/debit Card

From information I can find, technically since the card is "not a credit card". It cannot be reported as credit card debt.(found this on a government site).

Since it is a card card with Visa logo on it the consumer dispute process however is the same with visa. Disputes handled as any credit card would be.

According to the Visa Merchant rules and regs. The merchant can not attempt to recover chargedback amounts by submitting another transaction through visa.(doesn't mention by collection or contact with customer directly, so not sure whether it is legally final or not).

That is the question I can not find answer for. If Visa determines after investigation that the charges were fradulent, unauthorized, etc. I would assume that there findings could be used by cardholder as a defense to collection.

collection would be for upaid charges I suppose.

Most questions on this site regard collection of credit card debt.

Wish someone knew the answer
