Per divorce judgment - exwife (mom) is to pay 25% of medical bills not covered by insurance. We had a verbal that I wouldnt come after her for payment. However, recently she has changed her tune and is now petitioning for more support. So - I would like to petition for her to pay her past due on the med bills. I have them going back to the year 2000.

Can I petition for all the years? I have heard since I have 4 years of bills and never asked her to pay before - she will have 4 years to pay.

In May of 2003, my husband's ex took him to court for 5 years worth of copay's totaling 1700.00. He was never informed of this b4.

The order was in her favor. My husband was ordered to pay 900.00. How the attorney's came to that number, i do not know.

If you or your attorney need precedence for your case, please post back. I will give you his case number, the disposition date, and the judge. Once precedent is set, it is set. Tell the judge or your attorney you have case on point and you want your money back.

Topsidder - thanks for the info - I would love to get the case number, et. al. I am guessing we will only be allowed to get certain amount of the dollars due based on the time elapsed. That is probably why you only had to pay a portion of the full amount.

Do you have proof that you sent her the bills in a timely manner? A general rule is you have to send the bills within 30 days of incurring them, the parent has to reimburse within 30 days of receiving them. Did you send them certified mail, return receipt requested? If not, start doing that NOW!
