CA. We sold a car and sent in the gold rod sheet for DMV to Sacramento CA. About two weeks later we received in the mail a notice of sale from a wrecking yard saying they were selling the car for monies due. We found out that within 24 hrs the person we sold the car two was involved in an accident and abanded the car. We sent the wrecking yard copies of the bill of sale and a copy of the gold rod we sent to DMV. 2 more weeks pass and we get a notice from a collection agency saying we owe $750.00 dollars we informed them we sent paperwork to prove we had sold the car and we could send it to them, they verbally abused us and said we owe the money no matter what. We went to DMV and got proof that the car was sold and sent it all to them certified mail twice and they refuse to accept anything we send them. Now they are showing up on my TRW for collection. Do I have the right to sue them for damages and if so what type of attorney do I need?

You are going about this all wrong.... do NOT talk with the collection agency, their only goal is to get money (that is the ONLY way they get paid). It doesn't even matter if you don't owe them!!

You need to contact the creditor (the storage lot). Send them a Certified letter with your proof of sale. Demand that they correct their paperwork and contact THEIR collection agent. Also, demand that they advise you of the resolution of this in WRITING!!

To find out more, you need to read the FCRA (Fair Credit Reporting Act) at http://www.ftc.gov.
