College Refuses to Honor ADA Plan

I received a grade of "F" from an instructor who refused to allow me accommodations as agreed in a Disability Accommodations Plan. I had a B+ average. After pursuing every avenue of complaint within the college, I filed a complaint to the Department of Education.

The DoE representative told me that my complaint was very realistic and serious, that the school hasn't been coorporating as directed, has not turned over certain documents requests two months ago, and that they have hirred an attorney.

I want to know why they think they need an attorney. Is it to defend them against the DoE, or does it have something to do with some power I hold of which I'm not aware? i can't find an attorney to answer this for me, and one told me that no lawyers pursue these cases because the outcome is not profitable.

I would suggest contacting legal aid. Also who is paying for your education? You need to inform them as well. If they take federal monies they are required to apply Rehab. 504 period. If the SSA for example is paying your bill or the VA they can act as your advocate. The fact that they have sought counsel could me they see a possible tort claim and want to protect themselves. What I have learned very recently is that most schools back up their faculty to the extreme. The possible lawsuit you have for discrimination based on disability could be huge so keep looking until you find the right lawyer. I would look for help also with disability service organizations as they can be a big help. Google it and stay focused, when you fight the educational system it can be a long road. P.S. Keep track of how your disabilities have been affected by this action keep all medical appointments and document everything!..Good Luck
