I have a situation, in which, I worked for a major automotive manufaturer and suffered a cervical/spine injury, that, at time of W.C.C. Hearing, my atty coerced me, into taking out of court settlement, it was on the record, in form of a "clincher". He misrep. "my" injury as another, with less severity, and "threw my case" so to speak.I didn't know at the time,that the doctor, he'd sent me to,(after 10 mos.under her care) has not, to date, diagnosed my injury (her office called me, "THE" day,the check came in,to set me up with appt.to see her, I've never returned the call.). A helpful employee, (who has since been terminated) in the attys firm,had, by then, already given me "the" actual documents,from my Hearing. The W/C Commissioner did reveiw them, but I didn't even recognize "my" injury, when I (much later) reviewed them. Nearly ALL of the medical pages had been altered to some degree, and some, I'd never seen in my life (such as date and place of injury, insurance claims for unnecessary tests, her monthly medical notes for me, falsify all info. of my original injury, also,some totally different disability documents from employers' disability comp. they are involved also, even down to "my" family doctor! (my attorney was nearly "raised" by my g-mother). The check did arrive with releases from employer and their insur. carrier that, both, stipulate,"Cervical/Spine Injury" It's been 1 1/2 mos. I refuse to sign them,status of W.C.C. file is still "open". QUESTION:What (or can I) can I do, to remedy this whole problem, and to get my fair compensation for this injury? There's a "brotherhood" somewhat, of attys in this area, a new atty has been difficult to find. Thank you in advance for any advice.
