I am about to go to court to settle alimony/child support. I found out from an attorney friend that my wife's attorney and the judge were partners until just a year or two ago. My friend says this atty has this judge hear nearly all of her cases. My atty says there is nothing we can do unless we can show evidence of the case being mishandled. I am not interested in proving anything I just want a level playing field. Another friend says I may want to feign illness (chestpains) the day of the trial. The resetting of the date will allow for a new judge to be named. This seems grossly inappropriate and hopefully unnecessary. Any legitimate ideas? State of NC. Thanks in advance.

You are entitled to ask for a change of judge.

That will mean your hearing probably won't go until later, but if you feel you're not going to get a fair hearing, your attorney can petition for a change of judge.

Perhaps your attorney doesn't feel that your worry is credible and that's why he or she hasn't suggested that to you.
