Commercial noise

What is the name of your state? MI

There is a large business ( 200+ acres) behind my property. Never had a problem with them in over a decade - until recently. They expanded their operation to the chunk of land behind my house. Now ??? 6 days a week all I hear is back up beepers and the slamming of truck bed tailgates from 7am - 7pm. NON stop all day Monday - Saturday.

Since they expanded there is NO WAY to enjoy our backyard anymore at all. I stopped reading in my backyard, stopped entertaining - bon fires, barbques...... - stopped sitting in my swing enjoying nature ...... now when friends come over ?? We sit in the house. We cannot enjoy going outside anymore. How sad to be cooped up indoors when we have a beautiful, open, expansive landscape behind our home that we used to love & appreciate in awe !!! No more bocce, no more croquet, no more bon fires and no more enjoyment at all.

It is constant and every day. To the point that I was driving in my car and heard back up beepers in my head. NOT KIDDING. It is driving me crazy. But i dont bother going to the city council because they never do anything and always side with commercial over residential in our small city. What can I do besides move ?????

Do you have neighbors who are likewise bothered by the noise?

Unless there is a local noise ordinance and they are violating it or there is zoning issue there is little you can do.

What is the city's reasoning for allowing it to continue. Just saying that they "always side" with them doesn't tell us the answer to that.

It could be possible to have constructed a noise barrier wall along the property line - but whether the cost to build the wall can fall on the business alone or the homeowner(s) alone or be a shared cost would need to be negotiated.

Have you discussed this with the owner of the company? If so...what was their response to your complaint?

Unfortunately, the area in which they expanded is FAR too high to put in a wall or trees. You would have to plant fully grown, 30- 50 foot trees to make a difference - or a wall that is 30 - 50 feet high.

Well there IS local zoning and ordinances regarding the time frame they are allowed to do this kind of activity. They OFTEN violate that and are working at 6:00 am , 6:30 am , 6:15 am ........... beyond that they are within the time frame that allows this activity.

I guess you will need to report any noise violations when the noise occurs past the hours permitted by your local ordinance, and you could express your displeasure to the business (in writing) ... or move.

What is it you were you hoping could happen? That all business operations on the property owned by the business would cease?

No I was hoping they would have to relocate their expansion to the other 90 acres that is unused on their property. I was hoping that maybe I had rights to enjoy my home, yard, outdoors and not have to keep my windows closed all year........ I never expected all the operations to cease. I never had a problem with their business or the noise until they expanded behind my home. But thanks for being so cordial.

I apologize if my response did not seem cordial. I was honestly curious what you saw as a solution.

Noise barriers tend to be the most common solutions to noise problems. For example, you said your neighbors have tree barriers that block the sounds. Walls generally work well, too. Apparently neither of these common solutions will work for you, however.

You have already said that your city council is unhelpful and will ignore your concerns.

I see no law you can invoke other than the noise ordinance.

So ... you should try to work directly with the business, to see if their current operations on their property can be changed so you can enjoy your property once again.
