Hello,

I have a quick question related to whether filling an injunction in the context of commercial property (Ontario, Canada) currently under Notice of Sale dated 3 April 2013 is worthwhile exploring as an option.

We are very close to securing institutional mortgage with BDBC and our deadline from the vendor is 16 May 2013. We are at the stage of having to forward an Environmental Phase I report from the builder and we got the VP of one of BDBC branches to push this through. The VP seems to be positive and sees no issues with getting a commitment letter (e.g., details of the building, business, existing down-payment etc). But it seems to me we are going to run out of time ref 16 May '13 deadline because of delays outside of our control.

My dad is clueless about his rights meanwhile I did all could since Friday when I found out about this situation.

Is filling an injunction an option at all?

Are there any other options available to us in this context?
