What is the name of your state (only U.S. law)? WA
My husband was a general manager and earned commission based on sales. The sales were considered closed when the contract was signed and initial payment was made. He was paid on these sales the second paycheck of the following month. He quit his job effective 9/4 and was told he would not be receiving any commission from August or September sales he made, and would only be receiving one week of the two weeks of vacation time he had.
I believe (could be wrong) that Washington state says commissions earned must be paid to him unless there was an agreement between he and the company stating otherwise? I told him to ask payroll for documentation where he agreed to this policy. My questions are:
1. Am I correct about Washington law and commissions?
2. Does company policy have to be agreed to by both parties? i.e. signature
3. If this is company policy, in what form would he have to be made aware of it? i.e. simply being in an employee handbook? being sent an email notification?
