I am working in sales and am about to leave my current employer. I am paid a salary plus commission. The commission is based on achieving an annual goal, but is paid out monthly based on achieving a monthly goal. The compensation program states that if you work a partial month, you will not receive any commission. I told the HR person that this sounded illegal under CA law, and she explained that the commissioin was a draw, not an earned commission. This still does not make sense to me, since under this scenario you could achieve 100% of your monthly and YTD goal, and if you worked the full month and quit, you would get the commission for that month. If you were one day shy of the full month, you would get zero commission.
Is this legal?
