Can a real estate broker officially make a commission on the real estate side and as a mortgage loan officer on the same deal in New York. On one hand I'm told that as long as it is disclosed the real estate broker can make the commission of the mortgage as well, on the other hand I'm told the disclosure only allows the real estate broker to do both, not make money off of both. Now brokers I know either don't know, or are not concerned with this. Some of them have even clearly stated as long as they disclose it it is fine. Can someone here chime in and tell me the official legality of this?
