We are from Oregon and my fiance is a sales rep that earns commission. Is it legal for the company to revoke the commission on a sale if the sale is deemed too large? In other words they don't want to give her the commission because it is too much money. They have done it before and the sales rep didn't get one cent of commission for a very large order. I know it's not right but is it legal?

Depends.

Does your fiance have a written commission contract?

Answer that question first. And if he has one, get it so you can answer some questions about it.

If he doesn't have one, he's likely at the mercy of his employer, especially if he let this slide when it happened before.

The commission agreement is key ....

A good sales person needs to be looking for a more enlightened employer .

IN general, in your state , a commission is a wage and it falls under wage payment laws ....the employer is free to modIfy commissions going forward unless covered elsewhere by contract....but not to dock them retroactively once earned ..but there are lots of possible other detaIls in Commission agreement .

I was part of a large sales organization in a large manufacturing firm ....our commission structure was heavily weighted to encourage large sales and top performers did very very well. Something is wacky or missing in post if this employer is penalizing sales staff for making large sales......person needs to rethink where to work
