What is the name of your state? LA

My mom works for a collection bureau, collecting on delinquent medical and business accounts. She and her coworkers are paid commission only; however, the commissions rarely exceed what would have been earned had they been paid minimum wage. Work weeks consist of 40 hours. For some months, her coworkers earnings were less than $300. Can this employer get away with this?

Probably not; however it will depend on how LA looks at commissioned wages.

In most states, the company would need to make up the difference between her commissions and minimum wage. Louisiana law is a little unlike the other 49 states and there are no state laws regulating minimum wage - whether or not this would affect their stance commissions is unclear.

I would suggest that your mother contact the state Department of Labor.
