I am in a town home community, our HOA does not maintain our structures or roofs, they are only responsible for common grounds.
I am having a water leak problem with a neighbor. Our townhome's have a common wall, they have a leak from up near their roof that comes in behind the siding and ends up pouring into my home. The neighbor never talks to us, and now they dont care about our problem. Our HOA has rules for 'party walls' and easement across property lines to allow for repairs. The neighbor told me they have no money, I told them I was going to fix it and pay for it regardless what they say. They complained that I had a tarp under their roof, on their siding where the water was leaking from behind and into my home, with lots of indoor rain. I just went ahead and had roofers repair the problem as they did not even call anyone out to look at the problem since I alerted them of the problem. It was really urgent for me as we have had constant rainfall recently, and have another 7 days of storms coming up this week. I am wondering if I can sue them for the damage to my interior, and also the costs of the repairs. Our HOA rules state that it should be paid for by both owners on party walls. Anyone else ever have something similar happen?
