comp reducing my checks to next to nothing

What is the name of your state? ny
my job has no light duty, i have been on partial dissability for 2and half years ,i,m,e doc says i can do light duty work , but job has no light duty, now comp want to reduce my little comp check from 285 to 110 a week i have no skills but my own job which i,m waiting to go back to any one know why my check are being reduced to 110 a week ,does the judge decide this ,do i keep getting my 285 a week till i get to a hearing and get to see the judge ,this is really going to put me in the poor house, or should i say living in a carboard box with other homeless people what are they doing to me does anyone have any ideas,
i am waiting for a approval for a discogram test to be done even the i,m,e doc agrees i need a disco gram test done to see which disc is causing all the pain i have 2 severe herniated discs , so go figure whats going on with my comp checks :confused: :confused:

I know how you feel. I've been going through the same thing for over 5 1/2 years. Bottom line is, if you have an attorney remind them that they work for you and if you don't, get one. If anyone can learn from my years of frustration and pain, I would want you and anyone else to know is do your homework before selecting an attorney, check everything about them.....even 'A' rated attorneys can be slackers, mine is.

You aren't going back to your regular job until you resolve the herniated disc and maybe not even then. You have had 2 1/2 years to develop new skills, obtain an associate's degree, start on a bachelor's degree, etc. Apparently, your goal has been to exert zero effort to improve your position in life and are waiting on the good fairy to make life better.

Keep waiting and learn to live on $110 a week (or less) or change your attitude from helpless to self-sufficient.

EC you are an ignorant ashole.For your information many people suffer from disabilities and would love to get back to work. Mostly because of the low TTD benefits you receive.How about shoving a steel rod up your butt and try sitting in a class a learn a NEW career.I'm willing to bet you were born with a silver spoon in your prissey ass ,given what you want everytime you shake your rattle. If you have read this guys post,he has been trying in vain to get back to his job that he loves,Unfortunatly,as usual,W/C DRs. have been constantly giving confilcting opinions,.I happened to have had the same kind of crap pulled on me.You mention (and Im sure its unprofessional ,though accurate)he cant do anything until the disk situation is resolved.So in your infinate wisdom oh great one,how do you think this person will learn a new career while trying to recover from his herniated disks.Are you in any position whereby you can hire TiMM in hispresent stateof disability,or know someone whom can. Surely he would be happy to work under conditions that respect his restrictions. I am not ignorant; I know that "ashole" is correcly spelled, "a s s h o l e". I may have been born with a silver spoon in my mouth. I guess it fell out when they turned me upside down and slapped my rear-end. Prissey? maybe.

The reality of this guy's post is that he is not going to back to the job he loves until he gets his herniated disc 'fixed' and maybe not even then. He's had two years to decide what he is going to do for the rest of his life and it appears he has decided to live off of disability and pity until such time as someone makes it all better again and that ain't gonna happen.

The general population of the US seems to be suffering from the delusion that somebody owes (you) a living and all (you) have to do is show up or sign up. It's available if (you) want to live below the poverty level, just get old or sick/injured or have 40-11 illegitimate children and hey, the somebody will pay you a living. But--if you're like this poster and the idea of living off of less than $500 a month is not your idea of choice, then it's time to get a freakin' job.

As for my getting learning what it's like to be in the poster's shoes--been there, done that, bought the tee shirt.

to ellencee, read all my posts then talk ,you dont know what the hell your talking about this is for people who can lend a helping hand in the support area, where you belong in the unsupported group ,for people who do not read all posts, this site is for the injured who is tangled up with the comp system, and to let you know ellencee, i had surgery on my shoulder went back to work reinjured my self and now suffering from nerve damage and herniated discs was told by all docs that nerve damage and herniated discs sometimes and i mean sometimes can heal in time, so i waited it out with medication and under the speculation i was hoping to get back to work which i love i have been there 14 years and had good benefits which are still there waiting for me till this september, its a union job,
a good paying job and till the docs say to me i cannot do this type of work then i will move on. i have worked all my life and i,ve worked hard and i do not need someone like you who thinks you are a doctor to tell me that i cannot do my job anymore who are you to tell me this, i leave this to the proffesionals, if they say no more of this job i will look for other type of work, so back off, do not talk out of your butt because i do not listen to air heads especially when you dont read all posts, the nerve of you to even send this type of advice i listen to people with a knowledge of being injured if you dont have anything good to say dont say anything at all, my advice to you is just keep reading the posts maybe then your education for good advice and support to the injured will improve,you need a lesson in knowing how to use this site, :mad:

hi fireboat thanks for your kind support, its people like you that we need on this site i cannot deal with people who think the injured are happy living at poverty level , i sent him a note telling him he needs to read on, but you cannot teach people who think they are wanna be docs they have all the anwsers and dont know there ass from their elbow, he is telling me till i get my discs fixed i cannot go back to work is this guy a doctor , or should i say a wannabe doc , people like him i cannot listen to he needs to be on a different site for fools incorperated i have sent a private message to you fire boat ,and thanks again i,m hoping all the injured workers know that we are here to help one another if we can, we do not need advice from people who cannot give us the support we need i am glad you told the air head a thing or two thank you fireboat for all your help :rolleyes:

No you are the ignorant one....I can assure that in my field I have worked with and deposed hundreds of workers and the issue ALWAYS becomes somatic overlay when they are off work more than 6 months...of course if your too crazy to realize your crazy then there you go. The company where anyone is injured has to pay regardless of how stupid, fat or lazy they are if the "say" they are injured at work. Issues like self esteem and somatic overlay are worker issues that no employer should ever have to pay for, yet they do. EC is right, OP sat on his ass for 2 years...Oh, please George Bush, come git me from New Orleans, you owe me cause I be a citizen....

I'm willing to bet the LIL WEENOR and ellencee have no clue as to what WORK is.Or better yet heavy manual labor.Sorry ,but if you wear a tie,skirt or the like to work. You have no clue as to what hevy manual labor is.What I can say is,unfortunayly some of us never had silver spoons in our mouths,in fact I damn glad the plastic spoons I needed to use as a kid had food on it. You two have NO idea what humanity is,but I will tell you this. Your day is going to come. You will be grieving someday ,wishing someone will comfort you,give you some kind words. What it will be who knows. Maybe you will be stricken with some horrible illness,it might not happen to you. Maybe someone so dear to you you wish it was you. You can keep coming back here and playing your little piss contest. But when that gut wrenching,heartbreaking unfortunate incident happens,as your wiping the tears from your sorry eyes. so i would not waste your intelligence on two people that dont care how injured anyone is on this posts , ignore them and they will eventually go away people come on this site looking for advice and a little kind word ,they are the people we respond to ,the injured
that have worked hard all there lives and need to put food on the table to feed their families but are so much in pain , these are the people we respond to. we cannot respond with the 2 clowns that show no advice to the injured. people like that usually get their day.
they have no clue about what the other guy is going through and they need to educate themselves about lessons in how to treat people in a kind way, but they are iggronent,
and they need to be ignored i have no time for fools ,so we move on and give the idiots no response, let them live in their own miserable world they have each other ,two uneducated fools , there is a saying that goes like this,to understand something you need to know something these 2 fools like i said dont know there ass from their elbow its time they move on two another site their kind of advice is not needed here

I'm going to say this and then try my best to leave you raging lunatics alone...Part of what I do is to consult/assist with worker's comp claims (initial claim, continuing claim, re-evaluations, etc.). This OP's benefits are being reduced and he stands little chance of reversing the reduction in benefits. Why? Because worker's comp knowsthat persons with herniated discs can work and that the inability of returning to the job he 'loves' is not a requirement for continuing benefits. The reduction in benefits is a not- so-subtle message for the OP to be seeking employment that he can do.

It isn't fair to the OP to advise him to keep on fighting with worker's comp instead of doing what he can to regain his independence. Worker's comp will reduce and eliminate his benefits; it's only a matter of time. Advice to keep fighting with WC only insures that the OP will continue to suffer financially and emotionally.

The best is advice for the OP is to find work that he can do. The OP either has to resolve the herniated discs or do as many people do and work anyway.

Telling the OP to get a job and pointing out that he has had two years in which to find a job is not mean-spirited or unrealistic; it is the best advice for him and it is the truth.
