What is the name of your state? Kentucky

I have been the maintenance man (the only maintenance man) here at a 72 unit apt. complex in kentucky for a little over a year now. I work over 40hrs a week and 7days a week due to the fact that I am on call 24hrs a day. I do not get payed overtime and my comp time just keeps accumulating. I cant use any of my comp time because I am the only maintenance man here. I cant see how it is legal to give me comp time when i never get the opportunity to use any of it. Someone please help.

It isn't legal. Since you are working for a private employer and are clearly a non-exempt worker, it is ILLEGAL for them to be using comp time in lieu of overtime at all. Under the law, they MUST pay you overtime at the rate of time and a half for every hour over 40 in a week that you work. In your particular situation there are NO circumstances in which comp time would be legal, even if you were being allowed to take it. This would be true even if you preferred comp time to overtime.

Contact your state department of labor and file a complaint.
