What is the name of your state? Delaware

Have a Condo where the Condo association does not allow anyone but the board members to be in attendance at meetings nor do they make the minutes/monthly financial statements to any of the board meetings available to the residents. What rights do the condo owners have to attend board meetings and to information in the state of Delaware? Thank You.

Thanks for the response. I reviewed our Condo Declaration and could find no mention of the unit owners rights in regards to availability of the minutes nor anything about a unit owners right to attend a board meeting. I did find (see below) info on Delaware Law about minutes and all the owners having the right to attend a board meeting. Seems my condo association has been in violation of Delaware State law. To whom would I report this violation to?

2241. Notice and record of meetings.

(a) No meetings of unit owners or meetings of any council pursuant to this chapter may be held unless notice of the meeting, with the agenda for the meeting, has been either:

(1) Posted conspicuously in each building in an area open to all unit owners at least 7 days prior to the meeting; or

(2) Sent to the mailing address provided to the council by the owner and mailed at least 14 days prior to date of the meeting.

(b) All meetings of unit owners or meetings of any council shall be open to all other unit owners governed by the same council; provided, however, that where a portion of any meeting of unit owners or any council is reserved for consultations with legal counsel, or for personnel matters relating to employees of the council, such portion of the meeting shall be excluded from the provisions of this subsection.

(c) The council shall maintain written minutes of all meetings of unit owners or the council. The minutes shall be made available to all unit owners. (68 Del. Laws, c. 115, § 1; 69 Del. Laws, c. 94, § 1.)

To whom would I report this violation to?
Though you might try to report it to your state attorney general, it is far more likely that your only recourse against their conduct is for YOU to file a civil suit against the board.

Just to let you know how secretive this Board operates, a Board member was asked how would the Board go about switching Management companies. The response started off "Well, now wait a second, I don't want to tell you anything you shouldn't know." UNREAL !

I was unable to find anything specifically in the Delaware State Laws about a residents right to be able to videotape a board meeting. Nor, could I find anything in our condo declaration about videotaping a board meeting. So, would it be prudent to assume that videotaping of a board meeting in Delaware is permisable?
