I have recently discovered my wife has been having affairs, including with her X-husband (the father of my stepson). She and I have one child together. We are considering going to counseling and attempting reconciliation.

If reconcilitation fails and we have had sex during the reconciliation attempt, do I still have a claim for divorce on grounds of adultery?

She probably won't contest the divorce if reconciliation fails, however, does the adultery or condonation have any bearing on the custody of the child we have together?

Thanks

reconciling is reconciling, whether or not it fails.

Fault grounds can be taken into consideration when awarding custody along with everything else. If you reconcile it cuts off the fault grounds unless she does it again.
