Conflict of interest?

What is the name of your state? Colorado
My husband is accused of first degree assault. We had a family court matter going on when he was arrested for the assault charge and the judge that was involved in that case was transfered to criminal court the same division that my husband is going to for the assault case. Is this a conflict of interest?

Is this a conflict of interest?

No. But if his attorney thinks it is, then he can file to try and change the judge.

In some counties - like mine - it is very common to have judges wear different hats in different courts. This does not usually equate to a "conflict of interest". If he were best buddies with someone involved in the case, it might be a different matter.

Hubbie needs to bring it up to his attorney.
