I would like some opinions/advice regarding a possable conflict of intrest in a criminal drug case. Please bear w/ me while i explain the situation.
16 months ago a man was arrested w/ 2 codefendants on a marijuana case, i will call them A,B, and C. B recently turned into an informant against A,who is considered the ring leader. B also mentioned my name to police. As a result i was arrested & charged w/ MFG/PWID marijuana.
My lawyer also represents A, who is still fighting the case. The 1st problem i have is that the lawyer told me that the ada assigned to my case, and the former ada assigned to A's case, that they would "make this go away" if i would testify against A. The lawyer told me that he dismissed the idea w/ the ada. The 2nd poblem is that i have seen a copy of the warrent, and the statemets that B made about me. Some of the info B gave to the police could have ONLY been learned from A while they were on speaking terms. The Only place A could have learned this info is from the lawyer.
I am not saying that i do want to testify against A, it just bothers me that the lawyer may have to make a choice between clients. My case has not reached the preliminary hearing stage yet. WHAT should i do? IS there a conflict of intrest?
